Alibaba must face lawsuit in US over counterfeit Squishmallows

A U.S. judge rejected Alibaba’s bid to dismiss a lawsuit over counterfeit toy sales. Plaintiff Kelly Toys claims Alibaba knew and contributed to merchants’ infringement of copyrights and trademarks. Alibaba ignored “three-strike” policies and awarded infringing merchants “Gold Supplier” and “Verified” status. Jazwares reported $847 million earnings in the first nine months of 2023.

Alibaba faces lawsuit over counterfeit Squishmallows on its online platforms. Plaintiff alleges Alibaba ignored six lawsuits and awarded infringing merchants “Gold Supplier” and “Verified” status despite its “three-strike” policies. Berkshire Hathaway’s Jazwares acquired Kelly Toys in April 2020. Revenue of Jazwares totaled $847 million in the first nine months of 2023.

U.S. District Judge Jesse Furman said Kelly Toys’ claims against Alibaba are plausible. Plaintiffs alleged Alibaba contributed to the infringement of copyrights and trademarks. Revenue for Jazwares, the parent company of Kelly Toys, reached $847 million USD in the first nine months of 2023.
