Apple has been banned from selling its flagship Apple Watch models in the US due to an ongoing patent dispute as the Biden administration has declined to veto the restrictions. The ban went into full effect on December 26, 2023, after the US International Trade Commission found that Apple had infringed on two patents owned by US-based companies, Masimo Corporation and Cercacor Laboratories.
Despite Apple’s appeal of the ITC decision, the ban remains in place, with US Trade Representative Katherine Tai confirming the decision not to reverse the ITC’s determination. Masimo Corporation welcomed the ban, stating that it demonstrates that even the world’s most powerful company must abide by the law, and that the ITC’s decision should be respected to protect intellectual property rights.
Apple has expressed its strong disagreement with the decision and is taking all measures to return its Apple Watch Series 9 and Apple Watch Ultra 2 to customers in the US as soon as possible, while also affirming its commitment to upholding the law and protecting intellectual property rights.
