EXCLUSIVE-India probes DHL, FedEx, UPS for alleged antitrust practices, price collusion

India’s antitrust body is investigating DHL, UPS, and FedEx for collusion on discounts and tariffs. The Competition Commission of India began its inquiry in Oct. 2022 after allegations that the companies, along with Aramex and some domestic firms, were controlling customer discounts and deciding charges together. The CCI is reviewing hundreds of thousands of emails as part of the investigation and companies face hefty fines if found guilty of collusion.

The investigation follows complaints by the Federation of Indian Publishers that DHL, FedEx, UPS, and Aramex, along with domestic firms, were deciding charges together and controlling customer discounts. The CCI said companies appear to be sharing commercially sensitive information amongst themselves and taking joint or collective decisions to arrive at tariffs, if proved it will violate Indian antitrust laws and result in significant fines.

India’s antitrust body is investigating global delivery companies and domestic units for alleged collusion on discounts and tariffs. Companies under scrutiny include DHL, UPS, FedEx, and Aramex, and others. If proven, accusations could lead to significant fines under Indian antitrust laws, including a fine of up to three times profit in each year the fee was fixed or 10% of annual revenue for each year of violation, whichever is greater. The companies are currently fully co-operating with the investigation.
