Johansson alleges sky was modeled after her voice from Her, stating OpenAI infringed on her likeness. Legal experts suggest Johansson may have a strong case due to existing legal precedents, like Bette Midler’s case against Ford.

Bette Midler’s lawsuit against Ford in 1988 set a precedent preventing companies from imitating a distinctive voice to sell a product without consent. Midler’s case highlighted that a recognizable voice cannot be imitated for commercial gain. Scarlett Johansson could argue that OpenAI used a similar approach with the Sky voice mode. Tom Waits also won a lawsuit against Frito-Lay for hiring an impersonator, citing Midler’s case.
