DOJ, FTC to probe OpenAI, Microsoft, Nvidia over AI competition fairness

The DOJ and FTC are launching investigations into major AI companies for anticompetition issues. Nvidia controls up to 90% of the high-end AI chip market. The FTC will examine Microsoft and OpenAI for unfair advantages in AI and LLM technology. Amazon and Google also face pending AI-related investigations. The FTC is probing a deal between Microsoft and Inflection AI.

Roles are limited in investigations as the agencies haven’t confirmed or denied investigations. The lack of agreement limits each agency’s ability to investigate. In July 2023, the FTC opened a case against OpenAI for possible violations. In January, the FTC ordered Google, Anthropic, Amazon, Microsoft, and OpenAI to provide information about investments, partnerships, and competition for AI resources. The UK’s CMA also announced a probe into Microsoft, Amazon, and Inflection.
