EU may investigate Microsoft's OpenAI partnership for antitrust concerns regarding exclusivity

The European Union may initiate an antitrust probe into Microsoft’s partnership with OpenAI, focusing on certain exclusivity clauses. Microsoft invested $10 billion in OpenAI last January, receiving 75% of profits until recouping the investment and a 49% stake thereafter. The EU is also examining Microsoft’s hiring and licensing deal with Inflection AI.

The EU is evaluating whether tech giants are hindering emerging AI developers’ access to users. Samsung’s partnership with Google, integrating Google’s AI models into their Galaxy S24 series, is under scrutiny. The European Commission is particularly interested in Samsung’s use of Gemini Nano to power text generation features in their smartphones.
