Vertex Pharmaceuticals sued the U.S. Department of Health and Human Services over their fertility support program for patients prescribed the gene editing therapy Casgevy, claiming it does not violate anti-kickback laws. Medicaid does not cover fertility preservation methods, prompting Vertex to offer financial support to eligible patients. The Office of Inspector General raised concerns, but Vertex argues their program complies with anti-kickback laws, removing barriers to necessary medical treatment.
