Nissan wins appeal to decertify 10 class actions over alleged defective braking systems. Court rules improper grouping of drivers claiming the systems did not work. Some drivers never experienced sudden braking or sought repairs. Different software updates for models suggest no common defect. Case returned for further proceedings in Tennessee.
Class actions covered Nissan Rogue, Rogue Sport, Altima, and Kicks from 2017 to 2021. Lawsuits filed in California, Connecticut, Florida, Illinois, Massachusetts, Missouri, New York, Ohio, Pennsylvania, and Texas. Plaintiffs seek greater remedies at lower costs. Lawyers for drivers and Nissan did not immediately respond to requests for comment.
