Samsung has accused India’s competition watchdog of unlawfully detaining its employees and seizing data in connection with antitrust investigation on Amazon and Flipkart. The South Korean giant is challenging the investigation findings related to its conduct, arguing that the CCI illegally seized material during a raid at one of Amazon’s vendors.
Three Samsung employees were detained during the raid, with their phones seized and confidential data copied. Samsung has filed a legal petition seeking to quash the investigation findings and prevent the CCI from using unlawfully collected information. The company has obtained an injunction from the High Court putting CCI proceedings on hold.
The CCI has challenged Samsung and other parties with injunctions from high courts, asking the Supreme Court to hear all challenges together. The investigation found Amazon and Flipkart breached competition laws by favoring select sellers. Samsung denies wrongdoing and claims it was wrongly implicated in collusion with the e-commerce giants.
Counterpoint Research notes Samsung as one of India’s top smartphone players with a 14% market share. Datum Intelligence estimates 50% of phone sales were online last year, up from 14.5% in 2013. Samsung’s involvement in the Amazon and Flipkart investigation could pose legal and compliance challenges for the company in the future.
