Influencer Logan Paul is allowed to continue a lawsuit against “Coffeezilla” for defamatory remarks about Paul’s failed CryptoZoo project. A magistrate judge recommended denying Stephen Findeisen’s motion to dismiss the lawsuit, stating the claims were more factual than opinion. Paul sued Findeisen for reputation damage over alleged malicious statements.

CryptoZoo, Paul’s blockchain game, involved NFT “eggs” that hatch into animals to breed for unique animals. Findeisen called Paul a “serial scammer” and CryptoZoo a “scam” and a “massive con.” Despite disclaimers, the judge found Findeisen’s statements to be defamatory, rejecting the opinion defense.

Paul and Findeisen have 14 days to object to the judge’s report. Findeisen also released videos on CryptoZoo, which Paul did not initially sue over. Paul later backtracked on defamation threats, offering $2.3 million in refunds to claimants who agreed not to sue. Paul faces a class-action lawsuit from CryptoZoo buyers and countersued business partners for the project’s failure.
