Cryptocurrency industry groups are pressuring the SEC for formal staking guidance due to regulatory uncertainty. The SEC has engaged constructively in the past four months, but formal guidance is still lacking. Under the previous administration, the SEC took enforcement actions against firms offering staking services, but has softened its stance since then. The agency clarified that memecoins and stablecoins do not qualify as securities, but has yet to approve staking in ETFs or issue formal guidance on compliant staking services in the US. The industry is optimistic the SEC will eventually approve staking for cryptocurrency ETFs, including for proposed Solana funds. The IRS has also taken a stance on staking rewards as service income, which the industry opposes.
