Innovative Health wins $147m in damages from Biosense Webster in an antitrust lawsuit against J&J for withholding support services from hospitals using reprocessed catheters. The lawsuit initially sought $143m and was revived for a jury trial in 2023 after being dismissed in 2022.
A federal jury in California unanimously found Biosense Webster guilty of violating antitrust laws by denying support to hospitals using Innovative Health’s reprocessed catheters. AMDR President Daniel J Vukelich criticized J&J for impeding fair competition and urged hospitals to adopt guardrails against OEM retaliation.
AMDR advised hospitals to document threats, track SKU pricing, and deny equipment updates that hinder reprocessed devices. They emphasized the need to formalize guardrails, train staff, and inform OEM partners of hospitals’ intolerance towards anti-reprocessing tactics.
