A California jury cleared Levi Strauss of sex discrimination charges filed by a former executive, finding her lack of promotion was not due to her sex or pregnancy. The judge allowed her claims to proceed to trial, which resulted in a verdict after brief deliberation.
The former executive alleged in her complaint that she was passed over for promotions due to her pregnancy, gender, and age, while eight colleagues were promoted around her. She also cited violations of the Equal Pay Act.
The lawsuit proceeded to trial under Title VII of the Civil Rights Act of 1964 and other California employment laws, with some claims being dismissed. Levi Strauss denied the allegations but a trial was deemed necessary.
The outcome is unusual in employment law cases, as employers often settle before trial due to potential costs and juror bias. Recent jury verdicts include awards for sexual harassment, accommodation requests, and religious discrimination cases.
