Samsung India executives seek to quash $81 million penalty over tax evasion

Seven Samsung India executives are seeking to overturn $81 million in penalties as part of a $601 million tax demand from New Delhi. The tax authority accused Samsung of misclassifying imports, but the company has denied any wrongdoing and is challenging the order in court.
Employees are facing penalties for allegedly playing a role in misclassifying imports of mobile tower equipment from 2018 to 2021. Samsung India logistics executive Ravi Chadha argued that the penalty process was rushed and that no grave offense was committed, as it was limited to the interpretation of tariff entries.
The executives, including vice president Sung Beam Hong and general manager Sheetal Jain, have all challenged the tax authority’s order. Their lawyer, Sriram Sridharan, has not yet commented on the ongoing lawsuits, but their pleas for revoking the penalty are similar to Chadha’s arguments.
Chadha emphasized in his court filing that the penalty amount is too high for any salaried employee to afford, stating it would take him over 100 years to settle the amount with his current earnings. Samsung India and the executives have not responded to media queries, and the tax authority has yet to comment on the matter.
