Apple’s loses bid to halt court ruling that blocks some fees from its iPhone app store

A three-judge appeals panel rejected Apple’s request to pause an April 30 order banning the company from charging fees on in-app iPhone transactions outside its payment system. This threatens billions in revenue for Apple as it tries to overturn the order limiting its e-commerce commissions.

Apple sought to delay the order by U.S. District Judge Yvonne Gonzalez-Rogers, who held Apple in contempt and recommended a criminal investigation for possible perjury. This legal battle began five years ago when Epic Games accused Apple of monopolistic practices in the App Store.

Despite Apple appealing Gonzalez-Rogers’ ruling, the order blocking commissions on some in-app commerce remains in effect, affecting Apple’s profits. Epic Games CEO Tim Sweeney celebrated the decision, calling it the end of the “Apple tax.”

Gonzalez-Rogers’ 2021 ruling allowed apps to include links to alternative payment systems, leading Apple to comply with commissions of 12% to 27%. Epic Games then asked for Apple to be held in contempt, leading to the recent legal setback for Apple.
