A recent decision by a California judge allows investors in a 2022 lawsuit to pursue legal action against celebrities who promoted EthereumMax (EMAX). Class-action lawsuits in four US states will proceed, but a nationwide class action was denied. Cases involving EMAX purchases from May 2021 to June 2021 will continue in New York, California, Florida, and New Jersey.

State-level civil action can proceed against celebrities like Kim Kardashian, Floyd Mayweather, and Paul Pierce, as well as individuals and entities involved in EMAX, including EMAX Holdings and co-founder Giovanni Perone. Kardashian promoted the token to her 200 million Instagram followers in 2021, leading to the lawsuit.

EthereumMax gained attention in 2021 after celebrity endorsements, resulting in a significant price surge and subsequent crash, leaving investors at a loss. Despite initial dismissal of the class-action lawsuit, investors refiled about seven months later, overseen by the same judge. Kardashian settled with the SEC for $1.2 million for failing to disclose payment to promote EMAX.
