A Reddit user shared how her elderly parents in Alabama were drowning in credit card debt. After consulting a lawyer about filing for bankruptcy, they were told not to bother due to having no assets except Social Security income and old vehicles. They were essentially “judgment proof.”

The lawyer advised the couple to ignore their credit card bills, as creditors couldn’t garnish their Social Security income. Social Security benefits are protected from garnishment by federal law. Collectors can sue, but if there’s nothing to take, they can’t collect.

Despite constant calls from credit card companies, commenters confirmed the lawyer’s advice was legally sound. Some shared similar experiences of filing for bankruptcy with no assets for peace of mind. Others recommended sending a cease-and-desist letter to debt collectors under the Fair Debt Collection Practices Act.
