Ethereum-based gaming network Xai files lawsuit against Elon Musk’s xAI for trademark infringement and unfair competition. Xai has used the XAI trademark in US commerce since June 2023, including through its blockchain gaming ecosystem and the $XAI token. Musk’s xAI company has caused market confusion damaging Xai’s brand.

Complaint alleges confusion began after Musk announced xAI in July 2023 and deepened with plans to launch a gaming studio in November 2024. Consumers, publications, and even Musk’s AI assistant Grok incorrectly linked the two ventures causing marketplace confusion. Xai faces negative consumer sentiment due to association with Musk.

Musk’s legal team pressured Xai over trademark rights, threatening cancellation of registration. US Patent and Trademark Office suspended several xAI trademark applications due to confusion with Xai’s existing mark. Ex Populus seeks cancellation of xAI’s pending applications, damages for infringement, and court order to prevent use of disputed name.
