A federal judge dismissed a lawsuit against Mark Cuban over the Dallas Mavericks’ partnership with bankrupt Voyager Digital. The lawsuit claimed false representations and deceptive conduct, but failed to establish personal jurisdiction. The case was filed in August 2022 after Voyager filed for bankruptcy, alleging misrepresentations and omissions by Cuban and others.
The judge granted a motion to dismiss, stating lack of evidence that Cuban conducted business in Florida or specifically targeted residents. The plaintiffs did not argue that Voyager was a relevant co-conspirator. The Moskowitz law firm, co-counsel to the plaintiffs, had not responded to requests for comment at the time of publication.
Voyager’s bankruptcy filing in 2022 was influenced by a crypto market downturn due to the Terra ecosystem’s collapse. Companies like FTX and Celsius Network also filed for bankruptcy protection. Do Kwon, co-founder of Terraform Labs, was sentenced to 15 years in prison for his role in the collapse, which wiped out $40 billion from the crypto market.
