Estee Lauder sues Walmart in California federal court, alleging the retailer sold counterfeit beauty products like Le Labo, La Mer, Clinique, Aveda, Tom Ford, and Estee Lauder on its website, without proper authentication. The lawsuit comes after an investigation into fraudulent products on Walmart.com.

Two of the counterfeit products mentioned in the suit, Estee Lauder’s Advanced Night Repair serum and Clinique eye cream, were also highlighted in CNBC’s investigation. Estee Lauder claims Walmart facilitated sales of fake products through third-party sellers on its online marketplace, profiting from the sales.

Estee Lauder accuses Walmart of promoting sellers on its platform without ensuring the authenticity of the products being sold. Despite Walmart’s careful selection process for marketplace sellers, counterfeit goods were still permitted for sale, potentially harming consumer trust in the brand.

Walmart’s online marketplace has been crucial to its growth and competition with Amazon, recently reaching a $1 trillion market cap. However, the sale of counterfeit products poses risks for Walmart, potentially eroding customer trust and exposing the company to liability.

Brands struggle to hold platforms accountable for selling counterfeit goods, as seen in the Tiffany v. eBay case. The bipartisan Shop Safe Act aims to address these issues by incentivizing platforms to vet sellers and products better. However, the bill has faced opposition from online marketplaces like Walmart, Amazon, Etsy, and eBay.
