Bruker and 10x Genomics settle patent dispute over Nanostring, ending ongoing legal battles

Bruker and 10x Genomics have settled a patent dispute over products from Nanostring, acquired by Bruker in 2024. The settlement includes global cross-license agreements for their patents and withdrawal of all ongoing lawsuits in the US, Germany, and the European Unified Patent Court. 10x filed the initial lawsuit in 2023, claiming Nanostring’s product infringed on seven patents. The district court of Delaware ruled in favor of 10x in November 2023.

Nanostring, which was bankrupt in February 2024, was acquired by Bruker for $392.6m. The district court in Delaware upheld damages of $31.6m but declined enhanced damages requested by 10x. An injunction was granted to halt sales of GeoMx products to new customers in the US. Bruker’s spatial biology division president, Todd Garland, planned to seek a stay on the injunction.

The settlement agreement between Bruker and 10x Genomics has been reached, ending the legal battles. Bruker’s Nano Group president, Mark Munch, expressed relief at putting the distraction and expense of the lawsuits behind them. This settlement allows the scientific community to continue using Bruker’s spatial biology platforms for research in oncology, neurobiology, and other fields without concern of litigation interference.
