Morgan Stanley says it will contest Dutch dividend tax evasion probe

Morgan Stanley is facing an investigation by Dutch prosecutors for suspected tax evasion related to dividends on Dutch shares. The subsidiary of a foreign bank based in Amsterdam is accused of offsetting 124 million euros in withholding tax on 825 million euros in distributed dividends between 2009 and 2013.
The Dutch Public Prosecution Service has stated that it will subpoena the foreign bank involved in the tax evasion investigation. The European parent company is also being held responsible for the alleged unlawful offsetting of withholding tax.
Although the prosecutor did not name the foreign bank under investigation, a source close to the case revealed that the probe is focused on Morgan Stanley. The bank has stated that it is aware of the investigation and will defend its position against the allegations.
Morgan Stanley has rejected the Dutch Prosecutor’s claims and plans to vigorously contest the accusations. The bank believes the decision is based on an incomplete investigation and lacks clarity in relevant tax legislation, despite its cooperation during the process.
