Oreo maker Mondelez sues Aldi, alleging grocery chain copies its packaging to confuse customers

Snack food maker Mondelez International is suing Aldi supermarket chain, claiming that Aldi’s store-brand cookies and crackers copy Mondelez products like Chips Ahoy, Wheat Thins, and Oreos. Mondelez filed a federal lawsuit in Illinois, alleging that Aldi’s packaging could confuse customers and harm Mondelez brands.
Aldi, based in Batavia, Illinois, did not respond to requests for comment. Mondelez displayed side-by-side photos of products in the lawsuit, showing similar packaging between Aldi’s Thin Wheat crackers and Wheat Thins, as well as between Aldi’s chocolate sandwich cookies and Oreos, among others.
Aldi, founded in Germany, is known for selling products under its own labels to keep prices low. The chain has over 2,500 stores in 39 states and recently announced a new CEO. Aldi has faced packaging lawsuits before, including a case in Australia over Baby Bellies snack puffs and in the UK over Thatchers lemon cider.
Mondelez claims that Aldi ignored requests to change confusingly similar packaging for Nutter Butter, Nilla Wafers cookies, and Premium crackers. The lawsuit seeks monetary damages and a court order to stop Aldi from selling infringing products.
