Representative Timmons Asks For Docs On SEC’s Historical Ethereum Approach

Republican Representative William Timmons has requested documents from SEC chair Paul Atkins on the agency’s treatment of Ether under Gary Gensler. Timmons stated that under prior leadership, the SEC did not provide a consistent view on Ether’s status. Gensler’s comments on ETH’s security status have caused confusion for market participants.
In 2018, SEC’s William Hinman said Bitcoin and Ether were not securities. However, Gensler’s refusal to confirm ETH’s status during a 2023 hearing raised doubts. Timmons highlighted the SEC’s approval of Ether ETFs a year later, indicating ETH may not be a security. The SEC closed its probe into ETH shortly after.
Timmons’ letter follows Coinbase’s FOIA request in 2023 for SEC documents on ETH. When the SEC denied the request, Coinbase sued for alleged FOIA violations in June 2024. A judge ordered the SEC to disclose certain documents, including a request from New York prosecutors for the SEC’s opinion on ETH.
