Genetic testing company 23andMe reaches agreement to sell to nonprofit led by co-founder Anne Wojcicki after filing for bankruptcy in March. Pharmaceutical company Regeneron initially announced as acquirer with $256 million bid, but Wojcicki’s nonprofit TTAM Research Institute wins bidding war with $305 million offer.
TTAM Research Institute assures customers will be notified of acquisition and will uphold 23andMe’s privacy policies, allowing customers to delete data and opt-out of research. Nonprofit plans to establish Consumer Privacy Advisory Board within 90 days of closing to ensure transparency and choice for customers.
Approval of acquisition by bankruptcy court pending as 28 state attorneys general, led by New York’s Letitia James, file lawsuit objecting to sale of genetic data. Privacy ombudsman and interim CEO Joseph Selsavage express concerns over consumer trust and data privacy if deal goes through. 15% of customers have already requested to delete their data since bankruptcy filing.
