Settlement reached between OTR and DAT after legal battle over factoring

The legal battle between OTR Solutions and DAT Freight & Analytics has ended, with DAT disclosing OTR voluntarily withdrew its lawsuit. This comes after OTR won a victory in court ordering DAT to suspend Outgo operations. Details of the settlement were not disclosed by either party. OTR will not have special presence on DAT’s load board post-acquisition.
Despite appearing to have the upper hand in court, OTR voluntarily dismissed its lawsuit against DAT. Cobb County Superior Court ruled in OTR’s favor, ordering DAT to suspend Outgo operations. The recent agreement between the two parties does not indicate any special presence for OTR on the DAT load board as before the acquisition.
DAT is now free to market Outgo factoring services on its platform after the lawsuit’s end. Outgo, a product of DAT, offers fast, transparent payment services for carriers. OTR and DAT have reached an amicable resolution, focusing on serving clients’ needs. Before the acquisition, OTR paid referral fees to DAT and had a creditworthiness checkmark on the load board.
The relationship between OTR and DAT involved referral fees and a creditworthiness checkmark before the Outgo acquisition. A non-disclosure agreement was signed in February 2021, followed by a referral and revenue sharing agreement in August of the same year. Both parties have declined to provide further details beyond their prepared statements.
