Pence was at the Capitol during the incident but refrained from labeling it an insurrection. He argued that efforts to bar Trump from the ballot undermine the democratic right to elect leaders. The Supreme Court is deliberating on the issue, adding to the uncertainty of Trump’s inclusion in the 2024 election. Pence previously withdrew from his pursuit of the Republican nomination and had criticized Trump’s role in the Capitol riots.

The Colorado Supreme Court decided to prevent Trump from appearing on the state’s primary ballot, setting the stage for potential impacts on multiple states and the 2024 presidential race. Pence had also previously withdrawn from his pursuit of the Republican nomination. In March last year, Pence slammed Trump, saying the Capitol riots put him and his family in danger.
