Senator Cory Booker and Congresswoman Eleanor Holmes Norton reintroduced a measure to protect marijuana consumers in legal states who live in federally funded housing. The bill, titled The Marijuana in Federally Assisted Housing Parity Act, aims to permit the use of marijuana in federally assisted housing in compliance with state laws. This move challenges discriminatory practices impacting tenants and ensures personal choices made in adherence to state law are protected.
Under current federal law, landlords can evict residents of federally assisted housing for cannabis use, even in states where it’s legal. The bill seeks to change this by preventing legal action against tenants in federal housing who use marijuana in accordance with state law. It also aims to restrict housing agencies from establishing standards that would deny admission to federally assisted housing for marijuana use compliant with state law.
The Marijuana in Federally Assisted Housing Parity Act would also direct HUD to issue regulations that restrict smoking marijuana in federally assisted housing in the same manner and same locations as the Secretary restricts smoking tobacco in public housing.
