The European Commission found TikTok and Meta in breach for not granting researchers adequate access to public data. Meta, for Instagram and Facebook, failed to provide users with simple mechanisms to report illegal content and challenge content moderation decisions. Facebook and Instagram lack a user-friendly Notice and Action mechanism, while all three platforms have burdensome procedures for researchers.

Facebook, Instagram, and TikTok have the opportunity to review the preliminary findings and respond to the European Commission’s investigation.
