Microsoft challenges the Times’ claim of inducing copyright infringement by offering products with OpenAI’s GPT model. The motion argues that the contributory infringement theory is flawed and fails to show direct infringement by a Copilot user. The VCR precedent is cited to support the argument that liability cannot be based solely on product design.
Microsoft refutes the Times’ allegation of violating the DMCA by removing copyright management info from training data. Similar AI lawsuits, like one involving Sarah Silverman, had these claims dismissed. The dispute continues between Microsoft and The Times over the legality of using OpenAI technology.
