The EEOC is looking into allegations of disparate treatment against White employees at Nike. The inquiry includes examining records dating back to 2018 and investigating race and ethnicity data usage. The regulator is focused on 16 programs offering race-restricted career development opportunities, among other criteria.

Nike responded to the EEOC inquiry, stating their commitment to fair employment practices. The company believes its programs comply with anti-discrimination laws and takes the matter seriously. Despite ongoing cooperation efforts, the EEOC has escalated the issue by enforcing a subpoena in court to access the required information.

EEOC chair Andrea Lucas emphasized the importance of investigating potential violations of federal discrimination laws. The EEOC is the sole federal entity authorized to address employment discrimination in the private sector. It collaborates with the DOJ’s Civil Rights Division for public sector cases to enforce anti-discrimination laws effectively.
