OpenAI Inc. and GitHub Inc. were not held liable for copyright violations by open-source software programmers who claimed their coding tool Copilot replicated code without proper notices. Judge Jon S. Tigar dismissed claims under the Digital Millennium Copyright Act but allowed claims of violating open-source license agreements to move forward. The legal battle continues with accusations of generative AI infringing on copyrighted works.
