The U.S. Department of Justice urged the Supreme Court to reject Trump’s request to delay the TikTok ban or sale, set for Jan. 19. The law requires ByteDance to divest U.S. assets. DOJ argued TikTok’s data collection poses a national security threat, while Trump seeks more time for a “political resolution.”

TikTok did not comment on the issue. The government claims China’s control of TikTok poses a grave national security threat due to data collection. Trump’s lawyer requested a deadline extension for divestment while the case is considered. TikTok argues the law violates free speech rights under the First Amendment.

If the law isn’t blocked by Jan. 19, new downloads of TikTok will be banned, but existing users can continue to use the app. Services would degrade over time without support. Biden could extend the deadline by 90 days if ByteDance shows progress toward divestiture. Trump’s stance on TikTok has shifted since 2020.
