Robert F. Kennedy Jr. is involved in mass litigation against Merck over its Gardasil vaccine. Kennedy awaits confirmation as HHS Secretary, which would give him authority over a special vaccine court. The litigation alleges Merck fraudulently advertised Gardasil as safe. Nearly 160 million Gardasil doses were distributed in the US.

Kennedy, along with other influential lawyers, aims to hold Merck directly accountable for Gardasil injuries. Despite facing discouragement due to limited compensation caps, Kennedy’s strategy has gained traction. Kennedy’s involvement has led to a coalition of lawyers pursuing Gardasil cases outside the vaccine court system.

The first Gardasil trial is set for January 21 in Los Angeles. Plaintiff Jennifer Robi claims the vaccine led to impaired mobility. Kennedy, Baum, and other lawyers are representing her. Around 200 Gardasil lawsuits have been consolidated in a multi-district proceeding. Baum credits Kennedy for educating lawyers on taking on large vaccine manufacturers.

HHS Secretary Kennedy could potentially remove vaccines from the special court, allowing for broader claims against manufacturers. Removing vaccines could lead to price increases or product withdrawals. Some oppose removing vaccines from the special court, arguing it helps consumers with minor injuries. Kennedy plans to discuss reforms after January 20.
